Welcome to APOFUTURE UG approbiert24. By using our approbiert24 (“ the Platform”) (“web or mobile version”), you agree to the following Terms and Conditions. Please read them carefully before using our Platform.

1. Acceptance of Terms:

By registering or using the platform, you agree to be bound by these Terms and all applicable laws.
BY ACCEPTANCE OF THE TERMS AND CONDITIONS AND/OR ACCESSING AND USING THE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE AGREEMENT (INCLUDING ALL TERMS AND CONDITIONS INCORPORATED HEREIN BY REFERENCE) (WITHOUT LIMITATIONS OR RESERVATIONS).

If you do not agree with (or cannot comply with) the Agreements, then you may not use approbiert24 platform.
The use of any personal information you submit to the Platform or that we collect from you is governed by our Global Privacy Policy ( “Privacy Policy” ).

2. Eligibility

You must be at least 18 years old to use approbiert24. If you are under 18, you must have permission from a parent or legal guardian.

3. Description of Service

approbiert24 provide the following features:
- Checking of certificates to ensure authenticated individuals and pharmacies are genuine
- Act as matching service between job seekers Apothekers, PTA, PKA and pharmacies, collectively referred to herein as “Users”.

3.1 The role of the platform:

The platform is not an employment agency or firm, and approbiert24 is not an employer of users. Users are not employees, partners, agents, joint venturers, independent contractors, or franchisees of approbiert24.
Users hereby acknowledge and agree that (a) approbiert24
(i) does not perform Tasks or employ any person to perform Tasks;
(ii) does not supervise, plan, direct, control, or monitor the work of users.
(iii) has no control over the quality, timing, legality, non-performance, or any other aspect (or the corresponding acts or omissions) of any work or Users, nor over the integrity, responsibility, competence, qualifications, communication, or ratings and reviews provided by Users with respect to each other; and (b) under no circumstances does the execution of a Services Agreement create any responsibility or liability on the part of approbiert24 or any employment or other relationship between approbiert24 and the Users.
Users are not authorized to act as agents for approbiert24 or to incur any obligations or make any representations on behalf of approbiert24.
approbiert24 is not responsible or liable for employee compensation, tax payments, or withholdings, including, but not limited to, applicable sales taxes, Harmonized Sales Tax (HST)/Quebec Sales Tax (QST)/Goods and Services Tax (GST)/Provincial Excise Tax (PST), unemployment or employment insurance, Canada Pension Plan, disability insurance, applicable value-added taxes, government social security, employer's liability, education levy, social security contributions, PAYE, or other applicable payroll deductions related to a User's use of the Platform, or personal income tax, or any other tax related or financial related implications at all. The users assume full and sole responsibility for all required and applicable tax and social security and other financial matters. Each User assumes all and full legal liability.

3.2

The Apothekers, PTA, PKA and the pharmacies themselves are independent contractors who provide services under their own name or business name (and not approbiert24 name) using their own tools and resources. The users choose the hourly rates for work, without deductions by approbiert24.
The users may:
(a) maintain a client base without restriction from approbiert24
(b) offer their services elsewhere, including through competing platforms; and (c) accept or reject offers

4. User Accounts

To use certain features, you may sign in with:
- Your pharmacy account
- You are responsible for keeping your login credentials secure. If you lose access to your account or uninstall the app without backup, your data may be unrecoverable.

5. Privacy and Data

We respect your privacy. We store limited user data in (Google Cloud), including:

- Login Data
- Profile Data
- Certificates

We do not sell or share your personal data with third parties. For details, please see our separate Privacy Policy.

6. Ownership and Content

All content, designs, text, code, and visuals in our platform are owned by the developer and protected by copyright laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform without written permission.

7. User Conduct

You agree not to:

- Use the Platform for unlawful or abusive purposes
- Attempt to interfere with Platform servers or data
- Misuse the Platform or attempt fraudulent transactions

Violation of these terms may lead to suspension or deletion of your account

8. Limitation of Liability

The Platform is PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

- We are not liable for any loss of data, wrong prices, or personal outcomes resulting from the Platform use.
- We are not responsible for any outcomes related to your use of the Platform.

9. Changes to the App and Terms

9.1 Changes to the Platform

- We may modify, suspend, or discontinue any part of the Platform at any time.
- We may update the Platform to add or remove features.
- We are not liable for any modifications or discontinuation.

9.2 Changes to Terms

- We may update these Terms at any time.
- Your continued use after changes means you accept the updated Terms.
- If you don't agree to changes, stop using the Platform

10. Termination

You may stop using Platform at any time.

We may suspend or terminate your access if:

- You breach the Terms and conditions.
- We suspect fraudulent or illegal activity.
- Required by law.
- We discontinue the Platform

11. Effect of Termination

Upon termination:

- Your right to use the Platform ceases immediately.
- We may delete your account and data.
- Provisions that should survive termination (liability limitations, indemnification) remain in effect.

12. Your Data Rights (GDPR):

If you are located in the European Union (EU), you have rights under the General Data Protection Regulation (GDPR) regarding your personal data. You have the right to:

- Access your personal data we store.
- Correct any inaccurate or incomplete data.
- Request deletion of your data ("right to be forgotten").
- Export your data ("data portability").
- Object to certain types of data processing.
- Withdraw consent at any time.

13. Governing Law and Jurisdiction:

These Terms & conditions are governed by the laws of Germany. Any disputes arising from these Terms or your use of platform shall be subject to the exclusive jurisdiction of the courts of Germany.
